With the current Writers strike how come The Soup on E! is still making new episodes?

E! writers are non-union.

Sorry, don't know if they are filming. But most shows like dancing with the stars, and the other reality shows [due to the fact they are done live], plus all shows that are done months ahead like the Simpson's are still going strong. I know that shows like the late show, Ellen, and some of the dramas in the US are not filming due to the strike. If the show is like ET, its able to keep filming coz it is telling what is happening around in entrainment.
